To New Delhi and back. Non stop movement, non stop attention, non stop interviews .. and back. From 31 degrees Centigrade to 8 degrees, from cotton shirts to woolen blazers and scarfs, from sweat off the brow to a sniffle in the nose … back !

And the greatest joy … a quick visit to hug the grandchildren Navya and Agastya, busy in preparing for their tests the next morning and getting close to converting themselves into black belt Ninja’s that become invisible after reaching a certain degree of proficiency on the Mac game console !!

From 6 in the morning you get the cameras on you as you prepare to leave for Delhi. At the house, at the airport, into the terminal, out of the terminal in Delhi, driving to studio of appointed channel and straight into a Q&A.

Its Star News at NOIDA, which is in UP but connects close to Delhi so within minutes one can drive into another state. It is a revelation ! Taken around from corner to corner of each operation, the assimilation of news, the disbursement of it to select group of seniors, its formation and language, its graphics, its edit and compilation, right to its final rendering by the anchor, it is a nerve shattering massive operation - one that is in motion 24/7 for every second !

Incredible !! Absolutely incredible !! And all run by a group of youngsters, diligent and devoted to the very end. The speed of thought and construct, before matter gets stale or before competition picks it up, is fierce. However do they manage it, is an improbability, which to me seems to have no solutions.

The topic for the day has a massive panel of pictures that adorns an entire wall of the office. It is dedicated to me today and the range and variety of all my pictures put together is such a revelation. A few different interviews later, a few autographs and countless photographs later a quick drive to another developed region to the Religare Office, partners in the funding of the film and an elegant but quick lunch with their CEO and then down there in the media room - Barkha Dutt, that very committed and intense TV journalist, panelist, organizer of debates on many a valid issues, columnist and gracious anchor.

The topic is of course TV and journalism and RANN. The supposed bashing, the purported effort of revenge, the mistrust and its own reflections, on linked politics and delinked associations. On impressions of how this medium could improve, on how we as public figures could improve, what we lacked and what they lacked, on how this most powerful medium could be used and misused in society in politics in life. . .

When you have a sensible and interesting and knowledged interviewer, there is a sense of achievement when the interview is over. For, quite unobtrusively, you have managed to match the other’s superior intellect, or at least tried to. It has always been a joy to talk to Barkha Dutt.

That over, rush rush rush all the way back into Delhi to the Taj ManSingh for the press conference without as much as a break even for a wash room visit. There is applause after the traditional promo is shown and there is immediate consternation and resentment towards Ram Gopal Varma for the anecdotal short piece of footage he has shot asking various people in the public what they thought of the television in the country. It was harsh. Nothing was complimentary about the electronic in it and the resentment from the fourth estate was I felt, not unjustified. You do not call the media to help promote your film and then the first thing you show them is how adversely they are looked upon by the public.

“Why call us to tell us how bad we are, in a conference where you are asking us to promote your film ?” is their very legitimate refrain.

Other issues about the film and its motive and ingredients then take over, but I did feel the additional showreel incident left a bad taste in the mouths of many. I spoke to Ramu about this later, after it was all over, and told him it was not such a good idea to show that extra footage, totally unconnected with RANN, a film, that eventually is a fictionalized story which puts media in a very positive light. He understood the point immediately and assured me that it would not be shown again. Wiser counsel prevailed !

Encourage debate and discussion. Encourage impartial self regulation. Encourage ideas that would in the long run work beneficially to both the estate and the community. Strike a balance not the gong. Always a pleasure to talk to Barkha. I hope it is mutual.

Politics then takes over. The ‘handlers’ jump in to try and rescue the interview by keeping it from being anything other than film centric. I disagree and encourage for more talk. My argument against this is as follows. If you are going to agree for an interview or a press conference, then it is not justifiable that you dictate the terms of the conversation too. That prerogative should always be permitted to lie with the media.

So the questions come, on my recent visit and meeting with Mr Narendra Modi, the Chief Minister of Gujarat and my association with this allegedly controversial politician. My offer to promote the state of Gujarat through publicity commercials that could garner more tourism for it, is welcomed and the administration shall come over to work out what and how the modalities could be executed. The grilling questions on this matter continue though.

“You are perceived as a secular example of this country, Mr Bachchan, how can you associate yourself with someone like Mr Modi, a stern rightist !? ” they ask.

I am surprised by this analysis and wonder what kind of people there are that would think of my visit in such adverse manner. I have come to the Chief Minister of Gujarat to seek tax exemption for my film, permissions for which are sanctioned by him and his office. I am going to meet the democratically elected member of a constituent assembly of the country as stipulated by the Constitution, because he is the power that shall grant those facilities. Mr Modi does not own Gujarat. Gujarat belongs to the country. Mr Modi is the elected member by the people, to run the State. Where else and how else do I seek exemption and from who ? Meeting Mr Modi does not make me, a confirmed apolitical person, a rightist. Neither does it make me an endorser of his alleged accusations. Let the courts and the system conclude or pass judgement on it. And, if I see wide 6 lane roads and development and greenery, what is the harm in acknowledging it.

By similar argument, my visit to Kolkata, a few days back, and to the hospital there, to see Mr Jyoti Basu, may his soul rest in peace, would make me a communist would it not ! Or one that I am about to make to Delhi’s Chief Minister Sheila Dikshit on similar ground of tax exemption,  make me a Congressite because she rules from the Congress party. Or the one that I am about to undertake to Karnataka to visit Mr Yedurappa, the Chief Minister, for tax exemption make me a follower of his party !! Ha ! Come on … guys … think of something more original !

If Mr Modi asks me to promote Tourism in his State, I would happily do it, because it promotes the State and thereby the country. I do not see any wrong in that.

Barkha Dutt expressed similar surprise when she quoted what Mr Amar Singh has expressed in an interview with her on similar subject. He had told her, even if Ms Mayawati, the present Chief Minister of UP asked Mr Bachchan to promote Tourism in UP the state, he would do it.

She reiterates her surprise in my interview - “But Mr Bachchan, this is Mayawati, the one who dragged you to court and registered cases against you, on land matters and school matters and other Company matters !!”

And my reply is the same. If she were to ask me to promote Uttar Pradesh I would happily do it. As much as I would do for any State that would ask me.

Ms Vasundhara Raje Scindia as Chief Minister of Rajasthan asked me to do the son e lumiere for the Amer Fort in Jaipur and I did it. Amarinder Singh of Punjab asked me to do one for the Sikh Museum that they were building and I readily did that. I am in preparation now to do another one on the Jallianwala Bagh in Amritsar. Gwalior Fort, Golconda Fort in Andhra Pradesh, Tirupati Fort, Khajuraho have all been done by me. I did these for the love of their significance in the history of our country, not because I wish to align myself with the political party that has been elected to rule that particular State !!

I have remained apolitical ever since I resigned from politics. I do not wish to go back there again. This I have confirmed year after year, interview after interview. I think it completely futile to even attempt to bring such ill conceived notions up for questioning.

The Jew after perishing went up to heaven and knocked on the door of the Lord and said -

“Lord !! is it true that we are the chosen people ??”

“Yes my son !” Came the booming response. ” You are the chosen people !”

” Well, Lord”, he said. ” Do you mind choosing someone else, for a change !!

Many a time have I felt like conveying this to the media.

    What a beautiful way to end the blog today. While said in jest it has tremendous significance and a deep insight into people and yourself.

    By becoming an icon for us you are placed in a strange position. For us you are someone that should be emulated - for your principles, for your ethics, for your neutrality, for your values. But at the same time for the media you are an easy target to get more TRPs.

    Humans have a tendency to raise some people to Godly status and then start looking for faults to pull them down. This is especially true of Indian, for some strange reason. We, as a people, first give you love and respect and raise you to an iconic status and then start looking for faults to chide you and make you human again.

    It was great to read the blog and understand your reasons for supporting Gujarat in their tourism venture. I too am one of those who wondered why you would support Modi but today’s blog clears up so many things. The ability to look at the bigger picture and support the initiatives of the country and not the person is a quality that would helps many of us live a better life.

    Dear Sir, we respect your views regarding promoting a state if told by the ruling C.M.
    Mr Modi is a wonderful human being. He attended one of the functions in Haridwar, and he speaks like a roaring lion. He is a very simple man and has improved Gujarat in leaps. I recently visited Gujarat after a long time and saw the difference.
    Best Of Luck to both the young ones, for their exams, I am sure Pujya Nanaji’s blessings will give them a lot of assurance.
    Seeing the trailers of RANN and will be seeing the film, in theaters soon. Best of luck and it seems to be an interesting film. Pray for it’s success. Any film which you are involved is bound to do well.
    Please do take care of yourself. All the flying you do, hope you are drinking plenty of water and doing your leg exercises while traveling in plane journeys. A very important routine. Drink plenty of water. Wriggle your feet in circles, clockwise and anti-clockwise. Walk around, don’t sit in one place for too long. Avoid drinking caffeinated drinks,i.e. tea, coffee, coke, Decaffeinated would be better. Also try and get a pair of DVT socks and a travel pillow is a must too.
    I sound hypochondriac, but the amount of traveling you do, either in a car or a plane seems a lot to handle. Just a concern Sir. Hope you don’t mind the nagging advice, but please follow. Pranams to you, your family and all the FmXt.

    Even though it must have been for a short while, I am glad you got to see the grandchildren again. It sure has been another packed day full of non stop activity.
    It’s too bad not to even get time for a comfort break. But it was a much busier day than the day before.
    Its a shame that the media are persistent in trying to tie you down to a political alliance but you did well with your answers and I do hope that the last part of today’s post will end their speculation on this matter. I am proud that you take the opportunity to promote India through the various historical heritages we have in various states of this beautiful country.
    I wonder why RGV decided to show media in bad light when he is seeking their support to promote his film? It sounds like this was not well coordinated between all of you who were involved. I hope there won’t be further repercussions from this.

    Let’s say you were German and Hitler was in power? Would you seek tax exemption from him? I do not believe a German court ever passed judgment on anything Hitler did as long as he lived. If you were Italian would you answer a request from Mussolini to promote Italian tourism? If you were Chilean and asked to do something for Pinochet? If you were Ugandan and asked to help out Idi Amin on a national matter? If you were an Indian in the age of Aurangzeb and asked to help out the country’s image among certain segments of the population? If you were Chinese, if you were Russian.. Mao.. Stalin… if you were Cambodian… Pol Pot.. If you were Iraqi… Saddam Hussein… If you were…. if… if… if…

    Isn’t it ironic? To defend a national abstraction anything can be defended. The very people that make up the nation might be sacrificed for the ‘national’. If you were Sri Lankan.. if a Tamil govt was in power.. if the very leaders who had ordered an assassination were in power? if the person who had carried it out, somehow by not killing herself.. if she too were a part of the government? if she were responsible for tax subsidies? If she requested you to help out the cause of Sri Lankan tourism.. if.. if… if… would you have asked for ‘evidence’? The judgment of courts?

    I believe you completely when you refer to your politics. I thought the same even before you said it. ‘Apolitical’ wouldn’t have been my word. But I do not have any doubts about your politics. With all due respect it is an insult to Basu to be introduced into this conversation. Leaving this aside what is the bar here? Those examples from history always seem ‘extreme’. And yet when they were contemporary.. Hitler was a dynamic leader.. a great leader.. he had so many sides.. he was a painter too.. But let’s accept there is no comparison.. is the bar that low?

    Your character in Dev broke off a friendship.. did not wait for the friend to go through court proceedings.. I wonder whether he would have done anything for the Amrish Puri character..

    With due respect….promoting a state is different from praising an individual while you go seeking for tax exemption. It will appear that you are praising in return for a favor. It is not a question of aligning with a political party but aligning with an individual who is in power for tax exemption or at least that is how it appears for people on the outside.

    Whether you want to or not, you are the chosen one Mr. Bachchan and as you said for a person who is a public figure there are no free lunches and that is the hard bitter truth of life. As you said life can be beautiful and as I responded life is both beastly and beautiful…

    Glad to see the spirited Bachchan back…I guess being in Delhi and among media brought the high spirits back or is it the black belt ninja’s…have a great morning and a great day.

    It’s quite ironic that when our own Satyam raised same questions (though more fiercely) on your visit to Gujarat and a meeting with CM Modi, I offered same observations as U offered in today’s post. Nonetheless he remained unconvinced and edgy and on the top of it some handlers (invisible moderators) of this blog kept deleting his posts on the subject and made it worse.
    Now, your initiative to talk on that voluntarily must bring relief and restore trust, at least in your approach and lookout.
    After careful thinking and rethinking I came to conclusion that most of the time and for most of the people (including Satyam, me and others) these objections are merely a verbal exercise to prove/glorify self. To prove/show one’s so called intelligence, feelings and nobility but in reality there is nothing concrete or sustainable. It remains and it is just living room discussion without any desire of any actions from a distance.
    It requires courage and clarity to do what U have been doing and will continue doing it. Let me clap and whistle for that.

There are people who think he is wonderful, obviously, and then there is his role in the riots after Godhara. Questionable, maybe. Unproven, maybe. But you will agree there is a shadow of doubt that has been there behind him ever since. He may have done a lot for Gujrat, the state may be thriving under him, but at best your alliance with him makes one uneasy. Please stay away from such associations that tarnish your good name, sir.

    I am very sorry to disagree with you on this one, Amitji. But I think the media had a right to question your actions. I do not fault them on this one. There is and should be accountability for one’s actions. For everyone. We are all answerable to someone or the other — we ordinary mortals owe explanations to our spouses and children. Politicians to the public (at least they should, as an ideal). You, the chosen one, the hallowed one, unfortunately are no exception.

    You will probably not like me anymore after this (if you ever did in the first place!!), but this is how I feel.

I think you should not engage with any of these figures without weighing the consequences very seriously in each case. Specially with those political figures who are very tied in with certain histories. The larger point here is that you are a public figure of enormous stature. Everything you say and so means something. This is perhaps unfair pressure for a public figure and perhaps even an inhuman requirement but much is asked from those to whom much is given. It is precisely your sense of nonchalance displayed in your response that invites my consternation today.

    More than half a century ago Vallabhbhai Patel (who was certainly no liberal in these matters) issued ’shoot on sight’ orders for anyone who dared to approach the Babri Masjid. as you know the issued has flared up time and time again. Patel however refused to put law and order in jeopardy and despite his sometimes tough stance on minorities refused this kind of politics at that juncture. It seems to me that one doesn’t have to be a liberal to applaud this sort of decision.

    Many years ago you suggested in an interview that you were more friendly with Sanjay Gandhi once upon a time. Later on it was Rajiv . I thought then.. but what about the Emergency? There was much that happened during that time that was disgusting in terms of some of the enforced social measures and so forth (Rajiv was of course blameless). I bring this up because this isn’t a right/left issue for me irrespective of the fact that, and to paraphrase a favorite critic of mine, I wouldn’t vote for anyone on the right even for a dog-catcher’s position. I do not condone pogroms but nor do I do so for enforced sterilizations.

    the media’s anxiety and resentment towards this critical anecdote of them shot by Mr. RGV is very much understandable. It is true that no one bears criticism, more so if it is the media, that fourth state which believes that it is the only entity that is entitled to criticise and question while it refuses any kind of criticism of its own attitude and ways of conduct.
    It is such a kind gesture from you to understand their situation and to ask Mr. RGV to withdraw this anecdote included in the promotion. But it should be an eye opening footage to the media as it comes from public readers, from those whom it addresses and tends to affect their views. It is better then to consider these views instead of rejecting and shunning them.

    Your decision and your consistent attitude to keep away from politics is one to be really admired and appreciated. being public figure gets your actions, deeds and associations to be always under scrutiny and judgment from both those who approve or disapprove of them, and it is sad that the media always try to seek attention making use of your name and allowing the emanation of these undesired controversies.

    I feel sorry that you have to face such an attitude by the media..

But, in light of this this unrelenting anxiety about ‘Media Bashing’ that show reel incident was highly unfortunate - I am cringing for you!! To be fair RGV’s faux pas in the media limelight have become his ‘pies de resistance’, or perhaps they always were. His brutal candour first alienates women from his film and now almost the media - Is it any wonder there is consternation and resentment? Marketing and public speaking or relations clearly does not appear to be his strongest asset, so its a huge relief he is taking your ‘wise counsel’ to save this film!

    You are not only the nations insignia or spokes person; but you seem to be that vital link connecting cinema, brands, national and international, political issues with the public. The personable face and voice of India. An insurmountable responsibility perforce, but there is no other capable of the job. Politicians certainly do not have the charisma; actors do not posses the acumen or experience. You are the chosen one and yet are regularly thrashed by the almighty hand that chooses you whenever a minuscule discrepancy arises! You dare to hazard an alliance with someone for legitimate business purpose and a furore follows! Even on this blog, people expect you to address international issues on behalf of the country and its incomprehensible to me! I’ve always identified this as tough love from a nation of devotees; everyone wants you to match ‘their’ paradigm of correctness - nevertheless its unjust and undue pressure on man already swathed in plenty!

    May I suggest you simply pack up and head for the hills Mr Bachchan… and I’ll meet you there with a getaway car…

    Promoting a state for tourism is in larger interests of the country. People have to rise beyond petty thinking. If people in media think like this it is bad for them. They must think dispassionately and also with a positive outlook. It is not what a Barkha thinks it is how media perceives. Honestly what sells gets talked about. It is exploiting human nature and unfortunately media is feeding on it. The young ones who run efficiently as you describe may not be having that LIFE”S experiences to fall back on and think deeply. A man with ages and lot of experience can only see through things. When you say you will promote Gujarat or Uttar Pradesh despite opposition it is your magnamity to dissociate politics from development. To dissociate individual deeds from larger good of people. I must say it is your greatness that you remain apolitical.
    Hugs for Agastya and Navya from me too because in all your media and Rann story that is icing on the cake. A personal pleasure is always an oasis in life. We work to travel places but when we meet our loved ones it is like a shadow of tree on the roadside. Very sweet in hot sun.
    Ram Gopal Verma might have shown truth in the extra clip. Sometimes truth has to be also packaged well in some lies wrapper. No one likes naked truth.

    Did catch glimpse of your retreating back at the airport. We were discussing the frenetic pace of life of public figures at some point of time later in the day and how it makes them so uncommon. I did check the blog and was little surprised to not find the normal late night edition from Bachchandom.. it is all right.. it was on its way.. when I left the fray..

    What a speedy post.. I bet you would have finished it at quite some pace.. I know.. at times.. the thoughts just burst into us.. and fingers also support.. I wish that were t happen to me when I type in Hindi.. but it does not.. and most of the time when i really wish to say or type out my thoughts in Hindi I do take a bacj seat and decide against it… bhaai kavita likhane aur type karne mein bahut antar hai..

    I did lik the post.. that is usual.. I liked the speed at which the post travelled.. der aayad durust aayad..

    Nothing very significant could be done since the morning.. I did see you word of caution to parents regarding the stress and pressures.. they have crated a lot of thier own pressures by doing far too many things in far too little time.. and the balance sometimes is not maintained in what is useful or gainful from what is a waste of time.. it is so easy to say tha.. yet I would respect your concern.. I would rather want Savita to take a heed from your words.. too mjuch expectations from the young ones do put them under stress and press them hard when unable to get where they want to.. The Television which is so good in most of the things is one particular culprit.. some kids Amrit included do not know when to put brakes to watching TV.. they unknowingly kill their available time.. which results in poor time management.. on top there are computer games which also eat away a sizable time.. parents must find ways to control and curb these two activities to a stage where it does not create imbalance in their studies and growth in other spheres… easier said than done.. main to bilkul hi dhyaan nahi de paata hoon ki Amrit mhashay kyaa kar rahe hain aur kyaa nahi.. kabhi kuchh boltaa bhi hoon to bhaisahab mujhe hi daboch lete hain.. aap nahi khelte ho aap computer par ghanto nahi baithate ho.. vaakai meri bolti band ho jaati hai.. example is better than percept.. I shold first cut down and practice what I wish to preach..

    It is good to hear that you had a great time with Navya-Agastya and also had a blow hot blow cold experience from Mr Weather in Mumbai and Delhi.. meri to ab sardiyon mei dilli jaane ki himmat hi nahi padati..

    Here I did not write much about cricket.. as there was not much of competitive cricket till sometime bakc.. Yes, Bangladeshis cam quite close to India in the first innings.. that they fell short of just one run..

    More disturbing news comes from the IPL 3. Bhaai main to dekhane vala nahi hoon.. The kind of treatment that has been meted out to Pakistani cricketers by our franchisees smells of some kind of illness in their minds.. I would not blame Modi as much for it.. yet it speaks of his initial intent in almost closing the doors on the Top Twenty20 team.. I think besides commercializing cricket IPL is also going to politicise it as well.. very very wrong move.. and I would not be interested as long as the Pakistanis are not there in IPL 3.. I may alone be the looser.. so be it.. I did not see TRi-series for Praveen Kumar episode.. If Afridi, Gul and Tanvir do not find place in IPL 3 it can not be impressive of International level.. Pakistan is not only current champions they have great flair for this form of cricket.. records and statistics speak for them..

    Good Bye lalit Modi.. I did enjoy the first IPL.. I could sustain interest in IPL 2 but IPL 3 is out of question for non-inclusion of Pakistani stars.. I think it is time that teams are forced to have one player each from each of the major cricketing country like South Africa, Australia, Pakistan and Sri Lanka besides other overseas players..

    I do not think IPL 3 can loose its prominence by my not seeing it or watching.. my website would miss the statistics that hade been compiled and reviews that were written.. No comments on why did Franchisees did not pick Pakistanis yet full resistance to such ulterior motives..

    A word of caution that you may stick to your taking proper rest, health plan and follow strictly the sleeping hours and more importantly, the fixed time to go to bed.If you show any degree of negligence to the pattern, it may hit back hard on your health and temperaments later in life. Take care of it as health is God given.
    Regarding your acceptance of being an Ambassador for Gujarat, it is good that you do something above politics for the benefit of the state and the nation. As an independent observer, my earnest desire is that other states shall not be in similar race of getting film stars / icons for their states’ ambassadors and that craze is to be curbed in the beginning. The Tourism department and other related officers must work ardently to promote the values, development of each state and the CM is the amabassador of his/ her state, it is his/ her main responsibility to raise the standard, provide good infrastructures, welfare of the state and not necessarily by a marketing strategy thro a brand ambassador. Let us not mix the functional roles and responsibilities.
    The development as seen and felt by the people in the same state or from other states or countries would speak volumes for evolving further changes, progress and prosperity.

    Nice to hear about yesterday’s gruelling sessions you had to undergo while promoting RANN.

    A question that persists and needs to be answered is that does meeting an ailing 95 yr old should be seen as one’s willingness towards a political party or should that be seen as a courtsey??
    Like you i too have great regards for journos of the like Mrs Dutt,Mr Roy etc but what puzzles me is that how can such a question even surface given the intellect these wise people have.
    I mean they see and follow policital system on a daily basis,how can they be so naive in their thinking and can see one’s meeting that is usually related with seeking tax exemptions within a state for a movie linked with something that one has vehemently denied over the years.
    I would like to ask that if it is not a move to serve the viewers with “what they want” then what else is it.

    At times i feel sad when eminent journos ask these kind of questions.
    the basic problem is that news is not broadcasted “as it is” rather its presented “as it should be”.
    This is where the diffirence lies.And No matter how much you say or do they will never accept their fault.
    Well,that’s a human for you,accepting one’s mistake is the biggest hurdle that he can never overcome.Afterall it needs courage to stand up and accept your mistake.

    Meeting and socialising with people is a very healthy activity but in news its always seen as a person’s intention of aligning his activity with that of the person/organisation met.It’s sad and cannot change in near future.
    The only reason is that in todays’ world everything is linked with monetary benefits.
    Giving citizens the right news is actually a social activity nt linked to monetary benefits as you are serving the citizens of a nation,but it’s not seen in the manner it should be.Ad-sales revenues are more important than giving just the right news because the organisation will not have money then they will be unable to run,so they need more and more people to watch for which they need to sell sensationalism.That’s the crux of problem.

    In the same manner serving/treating a person of an ailing disease is a noble casue and doctors are supposed to be doing it even if a person is poor.\
    But if one is not financially strong enough to bear the burden of his medicines the hospitals n doctors ask them to knock another door.

    In conclusion wha i would like to say is that society as a whole cannot improve till the time their activities is de-linked from financial beneficials.

    I saw a highly apolitical Amitabh Bachchan in the latter half of the post..I saw how secular Amitabh Bachchan could get to be.. to be a member of the clans of not only BJP.. Communist.. Congress.. or even BSP.. The bottom line.. I found Amitabh Bachchan is apolitical enough when he meets and greets such diverse politicians with same ease and similar course of action upon meeting them..

    Well.. Brother.. you need not remain apolitical.. you have full right as a citizen of this country to practice and prefer one political pary over the other.. that you do no indulge in that kind of acts speaks volumes why you are loved so much by Modis, Basus.. Dikshits and Scindias.. who knows bahan Mayawati too has a deep idea doing in her mind as to how to invite you over for dinner and settle out different issues which she had been indulging and granting Tax exemption to Paa in UP.. and you taking up the cause to illustrate the Taj.. Varanasi.. and Lucknow’s traditions..

    Coming to more serious and pertinent issues, your being apolitical is absolutely your prerogative…it is your fundamental right to be that way if you so wish, but your logic and your stance regarding obliging anyone and everyone, should they request you to lend your face and your voice to promote their ‘territories’, does not go down very well with your personna, specially considering your lineage and your image. It is one thing to be dedicated to one’s work and be focused on it single mindedly….it is quite another to do so without a conscience. The political leaders you have mentioned above, whom you said you would have no compunctions to oblige should they give a call for you to further glorify and promote the States they are heading at the moment, are those people who have been proved, beyond a doubt, to have been guilty of excesses which should make any self respecting, right thinking citizen of our Country cringe with shame. Ofcourse, it is altogether another matter, that due to weilding power themselves, they have effectively escaped being punished so far. But for how long? It is not about you having to prove anything to your audiences or the world at large, but it has everything to do with the conscience you keep, as a right thinking, law abiding and honest citizen of the Country.

    I have admired you from the day you appeared in public life…without so much as even knowing anything about you…nothing at all…just on the basis of your talent and your body language with which you so effortlessly brought your characters to life, it would become difficult for me to hold the thought that you were someone else who was just play-acting that character! Then, as you grew in your profession and came into your own, I found my admiration growing alongside too, into an obsession, and today, I adore you - to distraction - as an Actor, as the Son of Dr. Harivansh Rai Bachchan, as Jaya’s husband and most of all as the human being I’ve come to know now, thru this excellent medium of your Blog! And this, precisely, is why I take the liberty of drawing your attention to the different aspects your stance would throw up.     So anyways the qn is, I see many celebs saying fight piracy, etc etc.. but my one simple qn.. why dont the celebs help us commoners fight high entertainment taxes (unwanted n unnecessary) and also the exhobirant ticket prices which the cinema halls charge us (recent example - one had to pay Rs 350 a ticket for movie- 3 Idiots). Wouldnt you agree piracy would have never spread as a virus today if we fought these taxes and ticket charges than asking us commoners to pay such high prices.

    I just finished with my radio show and it was twice the work as usual because in addition to filling out my usual playlist, I had to fill out the BMI College Radio Log which includes a space for the songwriters. It’s very hard to do all this when my average song lasts 2.5 minutes and I have to cue up the next tune! Luckily when I get to the last half hour and the Indian music, the songs are much longer. I played ‘Sara Zamana’ because of your post earlier this week.

    I was thinking about your argument about associating yourself with certain politicians. I understand it but I just have to say it would be very difficult for me to have associated myself with George W Bush or in a very extreme example, with Hitler.

    Today you have triggered a hot topic. That of making your support available for patriotic, heritage / brand build activities irrespective of the ‘baggage’ you vis a vis that person may carry. The concern and confusion is that it is juxtaposed with the tax exemption each of them is capable of giving for PAA. I guess we need to understand each issue independently.
    1.) You support the state because they are doing a yeoman service of brand building India through the rich culture and heritage which exists in each region.
    2.) The state sanctions tax exemption since the movie showcases the ‘normalcy’ with which a physically challenged child should be handled.
    3.) There is no ‘qui pro qui’ (in consideration of) here. Examples from both sides are :-
    Your voice over for sound and light shows of heritage locations in the earlier years surely did not precede / succeed tax emptions of any of your movies and Munna Bhai, Tare Zameen Par etc. did not have Sanju or Aamir promoing anything for those states that gave exemption.

    The quick hug with the grandchildren has disinfected you of the melancholy that persisted through the last few days ;)

    It’s good to be home after being stuck in the elevator of my building, pushing the alarm button and banging on the door for about 10 minues which seemed more like an hour. One of the building workers finally opened it and seeing me come home at this hour, ironically accused me of working too hard.

    Needless to say I will be getting plenty of exercise now walking up the five flights to my apartment from now on.

    Lately I’ve been feeling like that chosen person.

    It seems it’s time for U to offer your insight and observation on temporary undemocratic moderation and handling of this sacred blog just a while ago for a short period.
    While watching clips of your tour to Star news on you tube, couple of things popped out in brain. TV ASIA (Home away from home) still going on here in NJ, USA-almost unchanged and unfortunately seems without any vision, know how or proper management. It is a miracle that H.R.Shah on the helm of it has been able to continue this.
    Star news or any other Indian news channel’s anchors jobs are surely a tough and challenging but at the same time very responsive one. Unfortunately they turned out to be a weak link. They all seem to be mechanical, repetitive, dishonest and without conscience. Competition, policies and unscripted reporting undeniably turns into fictions, sensations and malicious stories.     Associatiing a person with politics just because he has gone to seek permission from an authorized person (politician) is unfair. It just couldn’t get more absurd. And those who keep crucifying Mr Modi for an incident for which he is not yet convicted, must hold on to their horses till the judiciary gives the final word. How many chief ministers have been able to match MrModi on the development front? He has created a state, where the whole world is standing in queue to invest…so it is better we respect the selfless serice of the man. I am no fan of BJP or nay other political part…Nevertheless I respect good performers and Mr Modi is one of them. As far as his non secular image is concerned…we are nobody to pass judgements…we have courts for that.

    We belong to a country where person like Kasab, accused of a massacre, is also given a chance to defend himself. So why be unfair to someone who has done so much for the country. Justice shall prevail…jornos please be patient and don;t paint every politician with the same brush.

Your last and most enlightening with her dispensed with any reservations I harboured about her slightly interrogatory approach to you previously on that ‘Bofors Blogging and the Ghandi‘s’ interview if you recall. Her caustic tone was my main grievance then; otherwise, she does epitomise professionalism and surely must hold you in only the highest regard.

    Personally I have a resolute resolve in all opinions I sustain. I cannot be overtly neutral and will not acquiesce to the opinions of others for the sake of having an opinion. Being ‘apathetic’ to political matters, will reserve judgement beyond reiterating that you are primarily an actor and dragging you into political mud slinging always seems unwarranted and unfair.

    Presumably neutrality for a public figure is the toughest stance to maintain. To the media who needs to categorize your opinions it implies impressionability and an opinion that can be persuaded under duress and this is the reason they try. Ironically though being neutral is the best position for you. The ensuing outrage if you did demonstrate partiality to any side does not bear thinking about!

    Anyway I am very late in my schedule today, just wanted to wish you well. Incidentally, I enjoyed the fruit’s of your labour for Rann yesterday. The articles are thought provoking and do place one on the raisers edge of curiosity 9 days pre-release! Admittedly some of your shenanigans at Star News had me in giggles for the day, but I won’t elaborate on which ones.

    I sincerely hope, beyond reason, this day has not been so gruelling for you and again its nice to see your clarity return, but please don’t allow your bountiful thoughts to continue flowing until daybreak again Mr Bachchan…

    This is a reality and is amply proved in last 3 Assembly elections. Modi has been elected to power for three consecutive terms with comfortable majority which is a record in itself.The city of Ahmedabad is free of communal riots now and all communities are living in peace .

    I have stayed in Ahmedabad for 2 years and it was difficult for me to move about freely in some areas of the city due to communal riots in 90s
    The branch of a Nationalised Bank I was In charge of used to remain closed on account of curfew at least once in 3 months.

    There is all round development of state of Gujarat during Modi’s tenure.
    By calling Modi names we are not only exposing our own mental deficiencies but also questioning the business acumen of Tatas, Ambanis and Mittals.Modi enjoys solid support of NRI fraternity

    The Gujarat riots were result of Godhra incident in which scores of hindus were burnt alive by the miscreants.Modi had nothing to do with the riots. Any stern action by the Modi Government could have resulted in heavy casualities.

    The Media is primarily responsible for damaging Modi’s image in the eyes of common man.

    dear friends,

    i am getting addicted to this blog. the void that shashi has left cannot be filled. but this sharing is working like a therapy. today i performed 12th day rites of shashi.

    my performing all the last rites was shocking to lots of people here. but i could not and would not have any other way. i loved him so much i had just had to do it for him.

    on the second day when i went to collect his ashes i was left in shock to see my shashi a good 90 kgs of tall well built husband reduced to mere 20/30 bones and ashes, being able to fit in a small earthern pot.

    i had to wait for his side of family to come from nagpur before i cud disperse them at sangam.

    i was clutching to the earthern pot and crying my heart out waiting for his relatives who were late due to some problem with their vehicle.

    it was like extending my grief. but i had no other choice but to wait.

    the time to letting go of the ashes was equally traumatic becoz that was the final letting go of something which i could physically hold. now whatever are left are memories which like fragrance i can feel but cannot hold physically in my hands.

    after that as per hindu rites i had to go to the ghat on 9th, 10th, 11th and 12th day that is today.

    tomorrow is the final of these rights the 13th day. pooja at home. rujula not aware of what the pooja is about but happy to have so many guests. i have decided not to display shashi’s photo and initiate any questions in little rujula’s head.

    but i am certainly feeling very very lonely at this juncture as all his relatives will be here along with mine and he wont be here.

    i am having a certain breathlessness, a certain twinge in my heart from morning today. everyone tells me i have a brave woman, which i dont feel i am. i just know that it is out of love of my shashi i am being able to do all this.

    i just keep remembering those lines ” chitthi na koi sandesh, jaane woh kaunsa des, jahan tum chale gaye “.

    i visited the hospital were he was taken after the accident to express my gratitude to the doctors, nurses, wardboys for whatever they did for him in that 30 critical hour of his. it was my misfortune that he left me, but the efforts of the hospital team does not overlooked.

    as it was accident i could not donate his eyes otherwise somebody would have been able to look thru his big black eyes.

    as i write all this tears are flowing a sense of helplessness prevails.

    we all love our families very much. we express our love towards children very easily everyday by kissing hugging them, getting them gifts or sweets of taking them in our laps etc etc. but we dont do so with our spouses. we generally take them for granted or just postpone saying how much we care.

    fortunately in my case i dont know whether it was premonition but i just told shashi just 15 days prior to his passing away how much i loved him, what he meant to me and how much is respect the efforts he takes to keep us happy.

    i request you all friends to take a pause tonite and tell your husband/wife how much you love them and how much they mean to you.

    thank you for allowing me to share my thoughts with you all.

    Your gujarat visit seems to have brushed few people the wrong way round. I personally don’t understand why all this fuss is around. Lets analyse it. Everybody knows the role of G.W Bush in Iraq & Afghanistan… Does that stops our PM or head of states from other countries including Middle-East from meeting him or doing business with USA. Our Secular PM MS has termed Bush as the best US president for India. Here PM is appreciating Bush’s support for india in clinching important deals like the one for Clean Nuclear Energy. In the similar light we should all view the visit of AB which was purely on professional front. He appreciated what he saw, he naturally can’t comment on what he hasn’t seen or is yet to be proved by the law of land. Congress is held guilty of organizing 1984 Sikh riots, one of the worst riots in history. Doesn’t our current Sikh PM represents the same party.

    it’s quite unbelievable that you can take up blogging within 12 days of your husband’s passing away. i don’t judge you for doing so but your courage and your thoughts, so clear thoughts, are quite unbelievable to me. someone who has 3.5 yr lil girl to look at and has entire future ahead without her soulmate; has a lot going on in her mind and soul and world, so it would seem to me.
    hence your blogging seems pretty unbelievable and unrealistic to me. you must be an extraordinarily strong woman. to my belief someone in your situation won’t remember their own address but you still remember the blog and its address. very very unbelievable. not trying to judge you again, but this entire blog writing within 12 days seems very suspicious to my cynical mind.

    I’m so sorry I think you misunderstood my meaning.

    I would not DARE to strike a comparison with Barkha to even be jealous and I wholeheartedly disagree with your overly generous words.

    My meaning was, that some months ago I had watched an old interview on NDTV from 2007, wherein I thought Barkha was too abrasive and intrusive with Mr Bachchan in her ‘methods’ of questioning.

    The aggressive interrogation and repeated attempts to goad him into speaking on matters he was uncomfortable with and clearly wished to withhold, were befitting for an MP or a politician and this is what I had objected to. It made me uncomfortable to watch it!

    But I agree with Mr Bachchan, she IS intelligent and quick witted and these traits can often be misconstrued as being brusque.

    I know exactly how you feel and the trauma you are enduring..I too had kept my husbands ashes in cupboard in a container for many months. And it is true..it is last physical connection..and very difficult to let go of. Let no one tell you any different. I remember vividly all of the details..everything down to the most minute. My daughter was 18 then..but no matter where in time we are grief is grief. Yes..and the loneliness is like a shroud we wear that no one can see.

    मेरा सौभाग्य,पूज्य बाबूजी का अपार स्नेह और आशीर्वाद मुझे प्राप्त हुआ और वर्षों बाद आपके पत्र से भी उसी आत्मीयता की अनुभूति हुई.
    इस वर्ष उनकी १०२ वीं जयंती के अवसर पर उनके साथ जुड़ी हुई स्मृतियों को आपके साथ बाँटते हुए मुझे बेहद ख़ुशी हो रही है. १९८२ में मेरे पहले कविता संग्रह “प्राणों के साज पर” की भूमिका उन्होंने लिखी थी. उनके मार्गदर्शन में गीत-गजलों की मेरी अन्य तीन पुस्तकें “अन्तर्बोध”, “श्रृंखला के खंड” एवं “अनुभूति दंश” प्रकाशित हुईं. १९८३ से ९० के बीच उनके साथ लगातार संपर्क बना रहा. इस दौरान उन्होने जो ३८ पत्र मेरे पास लिखे आज देखता हूं तो पत्रों का यह संग्रह एक किताब की तरह नजर आता है. मेरे जीवन की अमूल्य निधि होने के साथ-साथ इन पत्रों ने इस जीवन की दिशा तय करने में भी निर्णायक भूमिका निभाई. एक मौका था जब १८ फरवरी ०५ को उन पत्रों की कॉपी मैंने आदरणीया जयाजी को भेंट की थी. वे चुनाव प्रचार के दौरान यहाँ रक्सौल आई थीं.
    १९८५ में B.Sc. (Hons) के बाद मैं फिल्मों के लिए लिखना चाहता था. फिल्म रायटर्स ऐशोसिऐशन की सदस्यता मिली थी, बी.आर. चोपड़ा साहब का निमंत्रण भी मेरे पास था.ये बातें मैंने बाबूजी को दिल्ली में बताई लेकिन उनकी स्पष्ट राय थी कि लेखन को कैरिअर न बनाकर मुझे आगे उच्च शिक्षा का लक्ष्य करना चाहिए. विज्ञान के क्षेत्र में सफलता प्राप्त करने के बाद साहित्य का प्रयोग फिल्मों के लिए उचित होगा और तब लेखक के रूप में पहचान भी ज्यादा प्रभावशाली होगी.
    उनके निर्देश को अपना संकल्प बनाकर मैंने M.Sc. (Physics) में विश्वविद्यालय में प्रथम स्थान प्राप्त किया. Ph.D. की. Universal Equation के रूप में मेरे रिसर्च को अंतरराष्ट्रीय मान्यता प्राप्त हुई. त्रिभुवन विश्वविद्यालय में फिजिक्स के प्राध्यापक के रूप में कार्यरत रहा. लेकिन इस पूरे सफ़र में अपने लेखन को समृद्ध करने की कोशिश में भी जुटा रहा. मैंने कहानियों पर काम किया, अलग अलग सिचुअशन पर गीत-गजल लिखे. जिस भी अहसास ने दिल की गहराइयों को छूआ उसे कहानियों में, गीत-गजलों में ढालने की कोशिश करता रहा.
    पूज्य बाबूजी की वृहत साहित्य श्रृंखला में उनके इन ३८ पत्रों की कड़ियां भी जुड़ें, जनमानस इन अभिव्यक्तियों से भी परिचित हों, इस दृष्टि से इन पत्रों को पुस्तक रूप में प्रकाशित करना आवश्यक लगता है. साथ ही इन पत्रों की मेरे जीवन में भूमिका, हिंदी साहित्य में उनका महत्व, उनमें निहित नए रचनाकारों के लिए सन्देश तथा ऐसे सन्दर्भ भी इस पुस्तक में शामिल होंगे जो उनके व्यक्तित्व के अलग-अलग आयाम को रेखांकित करते हैं. चाहता हूँ कि इस संग्रह में आपके दो शब्द सम्मिलित हों और फिर इसका लोकार्पण आपके हाथों हो. क्या यह संभव है!

    I completely share your point of view. This was exactly my thought whilst watching this programme. Where are the men in these situations. I say ‘ men ‘ rather loosely.

    Women are left to defend themselves but moreover so are the children. Mother’s have to go out and work and leave their children alone. It’s a shocking but a common reality to many millions in not just India but throughout the developing world. Even in developed nations this is a reality. Domestic violence, alcohol abuse and money issue are often the cause of destruction of the family unit.

    I am appalled that this was the reality in India. The various charities, largely run by women, well only run by women is also a reality.

    I think you summed it up rather well, the shanty towns of India may operate blissfully and in harmony that is actually a hell.

    i don’t know whether you have noticed all those traits in dogs you have jotted down but my own experience confirms everything.

    we had two dogs –diana and devil–even the regulars like postmen would not dare to deliver post at our door step. they used to shout from safe distance.

    diana was more intelligent–as as is the case with most of the females—-she was very fond of veg briyani and would not stop barking till a plateful of her favourite dish was placed before her.she very cleverly used to open a pod of peas and remove peas therefrom . devil was ”mawaali” type. he often broke his strong chains and Lo! all children will run for their life on seeing him unchained.

    Bachchan Sahib I totally understand that you went to Gujarat to get the tax exemption and in return they asked you to promote the state. Your visit was purely a business visit. Mr Modi may have accomplished a lot for his state and one of them being the 6 lane roads that you noticed.

    I want to draw your attention to one famous case Roman Polanski a very famous film directory he committed sexual assault of 13 year old girl way back in 1977 but since he achieved so much for himself and for the film industry does that make him a clean man. Did law not catch up with him.

    So my question, by developing a state do you think Mr Modi has got all his sins wiped off, the major one being the mass killing of muslims.

    Bachchan Sahib a criminal is a criminal no matter how generous he is and It does not suite a person of your stature to even meet people like these.

    Justice will prevail and he will be proven guilty by the law.

AGAINST THE ACCUSEDS ABOVANAMED REGARDING COMMISSION OF OFFENCES BY THEM UNDER SECTION 63 OF THE COPYRIGHT ACT 1957 READ WITH RELEVANT PROVISIONS OF INFORMATION TECHNOLOGY ACT 2000 AND INDIAN PENAL CODE INCLUDING SECTION 465, 468, 469, 511, 120, 120B AND 34 IPC

    Respectfully showeth :

    1. That the Complainant is a poet and literateur and writer of literary poems, songs, satires, articles etc. The poems and satires written by him have been published in and admired and appreciated by various leading magazines and newspapers which have wide circulation throughout India like Hindustan Times, Navbharat Times, Rashtriya Sahara, Dainik Jagran, Tribune, Jansatta, Vir Arjun, etc. He has his own Blog with the internet address as http://dushantkumarchaturvedi.blogspot.com which is seen and frequented by literature lovers throughout the world. He has read poems and satires at more than 100 forums in Delhi and outside Delhi in last 12 years. He has also participated and read poems in famous programmes on TV channels like ‘Kaviyon Ki Chaupal’ on Sadhna Channel, ‘India Live’ on Jain TV several times. He is one of the major contributor of hasya kavita in the famous book “Hanste Reh Jaoge”. He also has to his credit various awards and accolades. He has been conferred with the honor of ‘Sahityashri Award’. He is the member of prestigious institutions in the field of literature like Akhil Bhartiya Sahitya Parishad (Regd.), Jai Bharti Sahitya Sangam (Regd.), Indraprastha Sahitya Bharti etc. In short, the Complainant is well known in the literature circles and is widely appreciated for his poems and satires.

    2. That few years ago, the Complainant wrote a poem / song titled “Jan Gan Man ki vyatha”. This poem on one hand expressed the story and pain of the national anthem, and on the other hand, depicted the economical, social and political environment in the country. It was basically an awakening song (Jagran Geet) dedicated to the country and countrymen and expressed the spirit of national anthem, the problems being faced by our nation and their solutions. Apart from reading the said poem-cum-song at various forums and stages and in TV programs, the Complainant also published and posted the same on his blog on 2nd December 2007. The said website is very popular and is visited by thousands and millions of people worldwide. A copy of the print out of complainant’s song-cum-poem is annexed with this complaint.

    3. That many admirers and fans of the Complainant read and heard the said poem-cum-song written by the Complainant and appreciated the same.

    4. That around 17th December 2009, when the Complainant was browsing the internet and chanced upon the website ‘youtube’, he was shocked and surprised to find that the song ‘Jan Gan Man Rann Hai’ from the film “Rann” being made by the accuseds has striking similarity with the words, essence and spirit of said poem-cum-song written by the Complainant. If the song written by the Complainant is dissected in paragraphs and the song in the accused’s said film is dissected in particular manner and if both are then read minutely and compared simultaneously paragraph against paragraph, it is not difficult to find that the lyrics and words in the accused’s song are completely inspired by and are taken from the song written by the Complainant. At some places, even the words are identically used in the accused’s said song and at some places, some different words are used deliberately but conveying the same meaning. A comparative chart showing and making comparison of the paragraphs from complainant’s song on one side and from accused’s song on other side is annexed with this complaint. The contents of the said annexure may be read as having been incorporated in this complaint.

    5. That the complainant is very much pained to see that the accuseds have not only distorted the complainant’s song but have also introduced negativity in the song.

    6. That not only the accused’s song, even the concerned scenes in the song in the film depict/convey the script/message of the Complainant’s song. The complainant’s work has been converted into cinematographic work by the accuseds without complainant’s consent.

    7. That a simultaneous reading / listening of the paragraphs of both the songs makes it obvious to any listener that the accused’s song has taken into consideration the song written by the Complainant. The substantial similarity in the two songs is not incidental or mere co-incidence but is intentional. The song in the accused’s forthcoming movie ‘Rann’ is based on the Complainant’s song which is a culmination of the Complainant’s original thoughts, opinions, ideas and labour.

    8. That from the above, it is clear the accuseds addressee no.2, stated to be the writer of this song in the film, has lifted the song in the movie from the poem-cum-song written by the complainant and available on the internet on his blog or from websites like ‘Orkut’ where he posted this poem-cum-song. The accuseds have copied the accused’s song from the Complainant’s song by twisting and modifying the words / language. The accuseds have adopted the Complainant’s work with colorable imitations. The accused’s song is a colorable imitation of the Complainant’s work. The said song in the movie ‘Rann’ is not the product of any skill or labour on the part of its alleged writer i.e. addressee no.2. On examining the two works i.e. complainant’s work and accused’s work and comparing the same in detail and minutely, it is clear that the accused’s work is an attempt on their part to copy complainant’s work.

    9. That as per Section 17 of Copyright Act 1957, the author of a work is the first owner of the copyright therein. Since the song, which is a literary piece of work, was originally written by the complainant and he is the author of said song, he alone has the copyright therein. As per Section 13, the copyright subsist in original and literary work. In view of Section 14, only the complainant has the exclusive right to reproduce his song in any material form or to make any cinematographic film or sound recording of the said song or to make any adaptation thereof and the accuseds have no right to modify or alter the complainant’s song. In view of Section 51, the copyright in complainant’s song has been infringed by the accuseds as they have adapted / modified / reproduced with modifications the complainant’s song and have made commercial exploitation of the same, without any license or authorization from the complainant.

    10. The accuseds have thus infringed the copyright of the Complainant in his poem-cum-song which is the Complainant’s original literary and artistic work. The accuseds have no right to use or avail of the labour and efforts put in by the Complainant in producing his song. The accuseds have no right to take away the result of the Complainant’s labour and skill, or in other words, his property. Section 63 of the Copyright Act describes the infringement or abetting of infringement of the copyright in a work as an offence. Since the accuseds have knowingly infringed and/or abetted the infringement of copyright of complainant in his song, the accuseds are guilty of the infringement of copyright of the Complainant and are thus liable to be prosecuted under Section 63 of Copyright Act. The accuseds have knowingly infringed the complainant’s copyright in the work and also the right to keep the work free from any distortion, mutilation or other modification.

    11. That the song-cum-poem developed and evolved by the complainant is the result of the work done by the complainant upon material which may be available for use of anybody but what makes it confidential is the fact that the complainant has used his brain and thus produced a result in the shape of a song and if accuseds are allowed to show their own song and film based on the song / concept originally conceived by the complainant, it will be allowing the accuseds to use that concept and to reap the fruits of the labour of the plaintiff.

    12. That the fundamental idea of violation of copyright or imitation is the violation of the eighth commandant : “Thou shalt not steal”, which makes the moral basis of the protective provisions of the Copyright Act. It is obvious that when a writer produces a poem or song, it is the result of his great labour, energy, time and ability and if any other person is allowed to appropriate the labour of the copyright work, his act amounts to theft by depriving the original owner of the copyright of the product of his labour. The object under Copyright Act is to protect commercial value of the productive effort of the individual’s mind and is intended to protect all intellectual property capable of extensive reproduction. The main aim of Copyright law is to secure a fair return to an author for his creative labour.

    13. That under the Copyright Act, the registration of the copyright by the author thereof is not compulsory. (Glaxo vs Samrat Pharma AIR 1984 Del 265).

    14. That the accuseds all have caused wrongful gain to the accused’s self and wrongful loss to the Complainant. The accuseds have thus also committed offences punishable under various provisions of Copyright Act and Information Technology Act 2000 and the Indian Penal Code.

    15. The accuseds no.1 is the Director of the film, the accuseds no.2 claims to be the writer of the song in the film. The accuseds no.3 and 4 are the Producers of this film. Since accused no.2 has been hired by accused no.1, 3 and 4 for composing the songs for their cinematographic film ‘Rann’, they are liable for the consequences of accused no.2’s work. It was in the accused’s knowledge that the said song in the accused’s film has copied the idea and the lyrics from the song of the complainant and despite this, the accuseds have never made any efforts to acknowledge the same in the media nor the accuseds have given due credit to the Complainant. The accuseds have used the said song without the Complainant’s consent. The copyright of the complainant has been infringed and injury has been caused to him in mind, property and reputation consciously by all of the accuseds acting together in conspiracy. The accuseds have been commercially exploiting the said song without even telling the Complainant. The accuseds have cashed in by means of this song by generating controversy and wide coverage and publicity on national print and electronic media and the internet and have earned money riding on the Complainant’s creation and intellect by saving millions on the publicity costs.

    16. The accuseds are also liable to give rendition of accounts and to suitably compensate the Complainant apart from giving due credit to the Complainant for this song by acknowledging his copyright in this song by way of appropriate insertion in the movie. The complainant reserve his right to file appropriate proceedings against the accuseds for rendition of accounts and for damages and injunction.

    17. The Complainant has come to know that the accused no.1 Mr. Ram Gopal Varma has been accused of violating copyright of other people also in the past in relation to the films and movies directed and/or produced by him. Some of these cases are Suit no.1892/2006 titled as “Sholay Media and Entertainment P. Ltd. vs Parag Sanghvi & others” in Delhi High Court (concerning movie ‘RGV Ki Aag’) and Suit No.324/2007 titled as “Kanungo Media (P) Ltd. vs RGV Film Factory & others” in Delhi High Court (concerning movie ‘Nishabd’).

    18. The accuseds no. 1 to 4 are jointly and severally liable for the said act of copyright infringement and plagiarism and dishonest and deceitful lifting of song from the Complainant’s song.

    19. That the Complainant gave the following complaints to the police, however, the police has failed to take any action till date :
    (i) complaint on 21.12.2009 (vide Diary no.LC-296) to the Police Station Mianwali Nagar
    (ii) complaint dated 4.1.2010 (received on 4.1.2010 vide Dy.No.D-44) to Addl. Commissioner, Economic offences Wing, Delhi Police
    (iii) complaint dated 4.1.2010 (received on 6.1.2010 to Commissioner, Delhi Police
    (iv) complaint dated 6.1.2010 (received on 6.1.2010) to Dy.Commissioner, West, Delhi Police

    The copies of the said complaints are annexed collectively with this complaint.

    20. That the complainant was constrained to send a legal notice dated 6.1.2010 to all the accuseds on 7.1.2010 by registered AD post. The said notice was duly served upon the accuseds (AD card has been received from accused no.3 duly received and the envelops have not been received back undelivered from remaining accuseds till date) but they did not respond to the same till date. This shows that they have no defence and confirms the commission of aforesaid offences by them. Infact, the legal notice was also pasted on the blog of accused no.1 (at rgvzoomin.com) and also at official website of ‘Rann’ movie (at rannmovie.com) on the same day. On 7th January 2010, the trailer of infringing song was being played on the said website but after receiving the notice, the infringing song has been deliberately blocked at said site by the accuseds. However, the infringing song is still being played on various sites including the website ‘youtube’.

    21. The accuseds fraudulently, dishonestly and unauthorisedly used the song written by the complainant and posted as a document on his blog and other websites. They forged the said document by tampering with the lyrics / words in the said document and made a new document i.e. song as well as cinematographic composition, with the intention to use and project the same as their composition. The accuseds no.1 to 4 are thus liable to be punished under Section 465, Section 469 and Section 471 IPC also.

    22. That the accuseds no. 1 to 4, by not being replying to the legal notice, and by acting in clandestine manner, have rendered their intentions illegal and unlawful and suspicious. There is a conspiracy between accuseds no.1, 2, 3 and 4 to deprive the complainant the fruits of his time, labour, energy and skills. The accuseds are thus also liable for the various offences under Sections 120 and Section 120B.

    23. That without prejudice to the foregoing, at least there is an attempt on the part of all accused persons to commit the aforesaid offences and they are thus liable to be prosecuted under Section 511 IPC.

    24. That the cause of action is continuing as the accuseds are continuing and abetting infringement of complainant’s copyright and deriving commercial advantage. The infringing song is still being played at the website “youtube” and other media.

    25. That the complainant saw the infringing song on computer internet at his home in Paschim Vihar, the complaint was given inter-alia to SHO police station Paschim Vihar, the fraud and infringement of copyright and commission of various offences has been committed by the accuseds within the jurisdiction of this Hon’ble Court and hence this Hon’ble Court has the jurisdiction to entertain and try this complaint.

    26. That the complainant has been adversely and seriously affected by the actions and omissions of the accused no.1, 2, 3 and 4 and is entitled to be granted justice by this Hon’ble Court.

    PRAYER :

    It is therefore respectfully prayed that the SHO of police Station Paschim Vihar or incharge of Economic Offences Wing of Delhi Police may be directed to register case / FIR against accuseds no.1, 2, 3 and 4 for commission of offences by them under Section 63 of Copyright Act 1957 read with Sections 465, 468, 469 READ WITH SECTION 34, 120, 120B

    AND SECTION 511 OF THE INDIAN PENAL CODE and other relevant provisions of law.

    It is further prayed that adequate and reasonable compensation amounting to double the amount of part payment made may also be awarded in favour of the complainant against the accused under Section 357 of the Code of Criminal Procedure ( or any other relevant provision) at the time of conviction to meet the ends of justice.

    2. That the complainant has given many complaints (annexed) to the police authorities (but they have failed to take any action till date on the complaints filed by the complainant with them. The offences are cognizable in nature ( As per Section 155(4), when a case relates to two or more offences of which at least one is cognizable, the case is necessarily deemed as a cognizable case) and the same are liable to be investigated by the police officers concerned. Thus, before taking cognizance on the accompanying criminal complaint under Section 190 CrPC, the Hon’ble court may first direct the police officers concerned to register the FIR against the accuseds and to investigate the matter.

    2. That the matter is urgent in nature. The movie ‘Rann’, which contains the infringing song and the infringing piece of cinematography, is likely to be released on 29.1.2009, as per the information gathered from the promos of this film and film circles. If the movie is released, it would not only be perpetuating further illegality and continuation of offences but would also cause irreparable loss and injury to the complainant. If the matter is not taken up urgently and urgent directions are not issued to the police to register the FIR in the matter, the accused persons may allege at later stage and unnecessarily abuse the complainant of delaying the case to gain undue advantage just before release of movie. If matter is delayed, then the accuseds may also be inconvenienced. It would be most equitable if the matter is heard urgently.

    I just watched the interview at NDTV. I felt that logically what ever you said was correct and thats the best way you could have answered on a show facing the Nation. You havent said anything wrong and you have made your stance clear . Towards the end of the show you did tell about the Span of career you would have which i guess is true and a thought crossed across my mind which i felt should be conveyed to you . I request you to do a work in Malayalam, where I wish to see you with Mr Mammootty, Mr Mohan Lal and Mr Suresh Gopi. and a Bigger version where you would have a work done with Mr Rajanikanth (Even though you have done films with him earlier) and Mr Kamal Hassan. A film which is better than “Hum” (where all Big Stars From India Join to make a film that could be called an Indian Film )Life is short and its the work that we do that will speak for us later .     I am writing after many months. Apologies for that. I just saw your interview with Barkha Dutt. For the first time I have a small contrarian view to what you said.
    I felt that you were trying to avoid any questions pertaining to your very affable meeting with Mr Narendra Modi. I wonder wht that was? Mr modi, as you rightly said, is a representative of the people of Gujarat. He is the best CM of India. Why should you be apologetic about your very pleasant meeting with him? You should not flinch against the media diatribe. They have their vested interests and political agenda, whereas you have none at all.
    Secondly, I feel that although you have been mistreated by the media most of your early career, recently they have started to throw a positive light on your work. So maybe you can remove some pre-existing bitterness from your heart and expect them to be a bit more unbiased in future?

    I am your biggest fan and will always maintain that you are the biggest, most charismatic superstar and actor that India has seen.

    Regarding mass killings which some people do write about i would remind them that because of integrity in Gujarat no one has been killed in the name of Language (Like Maharashtra) in the name of region(Like Andhra Prashesh) in the name caste(Like Bihar) in the name of Naxals (Almost all states of country except Gujarat) and also because of schemes like Cheeranjivi in Gujarat lives of more than thousands of women and their child in womb has been saved….Why don’t people take this into picture?
